Arab Man Ordered to Compensate Victim after Assault Incident in Dubai
Dubai courts mandate substantial compensation following a road incident and subsequent physical assault.
A man of Arab nationality has been ordered by the courts in Dubai to pay 300,000 dirhams in compensation to a fellow Arab citizen who sustained injuries after being run over while standing on the sidewalk.
The incident escalated when the defendant exited his vehicle and physically assaulted the victim, exacerbating his injuries.
The Dubai Criminal Court found the defendant guilty of assaulting another's physical integrity and imposed a fine on him.
Subsequently, the victim sought redress through the civil courts.
In a civil lawsuit filed in the Dubai courts, the victim sought compensation for current and future material damages, lost earnings, and moral damages arising from the assault.
He requested an additional 5% legal interest until the claim is resolved.
The plaintiff also asked the court to contact Rashid Hospital to obtain a certificate regarding the costs of future surgery needed to remove metal plates inserted due to the injuries from the incident.
The hospital's financial department initially estimated the surgery at approximately 45,000 dirhams but declined to issue the certificate, citing potential increases in costs over time, necessitating consideration for medical follow-ups, medication, imaging, and recovery time without pay.
The plaintiff indicated that he was present on the sidewalk when the defendant struck him with his vehicle.
Following the collision, the defendant exited his car, grabbed the victim's clothing, and twisted his arm, worsening the injuries.
A criminal report was filed regarding the incident.
An eyewitness, who was with the victim at the time of the incident, corroborated his account.
The public prosecutor charged the defendant with assault on another's physical integrity and subsequently referred the case to the Criminal Court.
The Criminal Court issued a preliminary ruling against the defendant, which was not contested, making it final.
The victim then pursued a civil remedy, presenting a copy of the criminal judgment and a forensic report, while amicable settlement attempts between the parties proved unsuccessful.
