Abu Dhabi Court Dismisses Man's Compensation Claim Against Woman for Defamation Allegations

Court ruling concludes that the defendant's actions were within legal rights to report claims of defamation.
The Abu Dhabi Family and Civil Administrative Court has dismissed a compensation claim filed by a man against a woman who accused him of defamation and insult.

The court had previously excluded him from the list of defendants in a related criminal case, leading to a ruling in favor of the woman.

In the legal proceedings, the man sought to compel the woman to pay him 51,000 dirhams as compensation for damages and psychological harm he claimed to have suffered.

He also requested statutory interest at a rate of 10% on the claimed amount from the date of the legal demand until full payment.

The man alleged that the woman had filed a complaint against him, accusing him of defamation and insult, but the criminal court had found insufficient grounds to substantiate these claims.

The woman, in her response to the claim, requested that the court reject the man's petition.

The court, in outlining its judgment, emphasized that the right to seek judicial recourse to protect legally recognized rights is a legitimate public right.

However, compensation liability arises only if the individual asserting this right has misused it to harm an opponent without legitimate interest.

The court reiterated that reporting crimes, which can lead to public prosecution, is a recognized right and a duty for anyone who becomes aware of such offenses, as outlined in Article 37 of the Criminal Procedure Law.

This provision exists to protect society from unlawful acts.

Thus, exercising this right or fulfilling this duty does not incur liability for the informer.

Furthermore, the court noted that for compensation to be awarded, there must be a proven basis of liability, which includes error, harm, and a causal relationship.

It found no evidence suggesting that the woman acted with malice or hastiness in her complaint against the man.

Consequently, the court ruled that the claim was unfounded, ordered the dismissal of the lawsuit, and mandated the plaintiff to cover the court fees and related expenses.
