Saudi Arabia Implements Landmark Personal Status Law Reform
New family laws introduce significant changes to marriage, custody, and privacy in Saudi Arabia.
Saudi Arabia has implemented the Personal Status Law, a substantial legal framework aimed at modernizing family law in the kingdom.
The regulation, consisting of 41 articles, was approved by Crown Prince Mohammed bin Salman and took effect on February 9, 2023. This reform is part of broader judicial modernization efforts aimed at reinforcing women's rights and updating marital laws and child custody provisions.
Under the new regulations, unapproved marriage contracts will undergo a structured review process conducted by the Minister of Justice and relevant authorities.
Additionally, the Ministry of Justice has been granted the power to introduce further regulations as required to adapt to evolving judicial needs.
A notable feature of the law is its requirement for official documentation of marriage contracts involving non-Muslims, regardless of shared nationality.
It also clarifies that a wife's right to annulment, based on the inability to maintain marital relations, cannot be forfeited solely due to a delay in taking legal action.
The law enhances privacy for couples by establishing that their privacy is considered to be violated if an observer capable of interpreting their relationship is present.
This amendment signifies an important step towards acknowledging personal privacy rights within the marriage context.
In terms of child custody, the new provisions stipulate that a mother retains custody of a child under the age of two, even if she enters into a subsequent marriage with a man who is not the child's father.
The Personal Status Law sets the minimum legal age for marriage at 18 and recognizes a woman’s entitlement to financial support from her spouse.
It empowers women to seek annulment under specific circumstances, reflecting a significant shift towards more equitable legal standards in marriage.
The Cabinet initially approved this framework in March 2022 as part of an extensive legal overhaul led by Crown Prince Mohammed bin Salman.
The Personal Status Law is one of four pivotal legal reforms announced in February 2021, which also includes the Civil Transactions Law, Penal Code for Discretionary Sanctions, and Law of Evidence.
Collectively, these reformative laws are designed to enhance judicial transparency and expand individual rights, aligning Saudi Arabia's legal framework more closely with international standards.
