The Abu Dhabi Family and Civil Administrative Court has ordered a vehicle owner to pay 80,000 AED to a cyclist following injuries sustained in a traffic accident, which resulted in a permanent disability in the cyclist's right shoulder, estimated at 20%.
In the case at hand, the claimant filed a lawsuit against the vehicle owner seeking 600,000 AED in total compensation for physical, material, and moral damages, along with the replacement value of his bicycle, court fees, and legal expenses.
He asserted that he was involved in a traffic incident caused by the negligent driving of the defendant's vehicle, which led to injuries detailed in a medical report.
The vehicle owner was previously convicted by a criminal court for causing harm through negligence.
The defendant submitted a response to the court, requesting dismissal of the case.
The court detailed its judgment, referencing the Civil Transactions Law which states that 'any harm requires the perpetrator to compensate for the damage.' The court noted that the defendant had been prosecuted for causing injury to the claimant due to his negligence and violations of legal obligations while driving.
This recklessness resulted in a collision with the bicycle ridden by the claimant, causing injuries.
The court confirmed the defendant's conviction and noted that the judgment was final.
The court further outlined that the defendant’s actions directly caused harm to the claimant, making him liable for the tortious responsibility arising from the accident.
A medical report, accepted by the court, confirmed that the claimant suffered a fracture in the front of the shoulder, resulting in a permanent disability of approximately 20%.
The report highlighted that these injuries lead to a permanent impairment diminishing the claimant's utility, justifying an allocation of 50,000 AED for the sustained disability along with 30,000 AED for moral damages related to pain and suffering.
Overall, the court awarded the claimant a total compensation of 80,000 AED and mandated the defendant to cover court costs and legal fees, dismissing any additional claims.
