Court Ruling in Dubai: Assault Leads to Permanent Vision Loss
A violent incident stemming from a WhatsApp exchange results in severe penalties for the assailant and a significant civil compensation for the victim.
In a disturbing case in Dubai, an individual of Arab nationality suffered a permanent loss of vision in his right eye following an assault triggered by a WhatsApp message.
The assault, perpetrated by an Asian individual, was reportedly a response to an insult communicated through the messaging platform.
The incident escalated to violence when the assailant punched the victim in the face, leading to serious injury.
The two individuals were referred to criminal court, where the perpetrator was sentenced to six months of imprisonment and ordered to be deported from the country.
Additionally, the victim, who was seriously injured in the attack, initiated a civil lawsuit seeking compensation for the physical and emotional damages suffered as a result of the incident.
The Dubai courts subsequently ruled in favor of the victim, awarding him 100,000 AED in damages.
The victim's civil suit claimed 150,000 AED in compensation, including 12% legal interest from the date of the claim until the sum is paid.
He argued that the assault, which resulted in retinal detachment and a permanent disability assessed at 35% by forensic medical experts, was caused directly by the verbal confrontation that took place via electronic communication.
The initial criminal court sentencing found the assailant guilty of bodily harm towards the victim.
Despite the assailant's appeal to the Court of Appeals, the original judgement was upheld, leading to a final ruling from the Court of Cassation that closed the criminal proceedings against him.
Following the finalization of the criminal case, the victim pursued damages in the civil court due to the severe injuries he suffered, which included not only the loss of vision but also various other injuries to his head.
The civil court reviewed the case and noted that the assailant's actions constituted a clear violation of the victim’s bodily integrity, resulting in both physical and emotional harm.
The court confirmed that the legal framework in Dubai mandates adherence to the findings of criminal courts in cases involving civil claims arising from those criminal acts.
It noted that psychological damage, which encompasses harm to dignity and emotional well-being, is recognized under the law, and the assessment of this damage is within the purview of the civil court.
Ultimately, the civil court determined that as a result of the attack, the victim incurred both medical expenses and an interruption of his work activities, alongside emotional distress from the trauma of the event.
It granted him a compensation amount that reflects both the tangible and intangible damages sustained, amounting to 100,000 AED, along with a legal interest of 5% from the date the judgement became final.
